Terms of Service (TOS)

Welcome to The Attic Bats! By using this website, commissioning artwork, or purchasing items, you agree to the following terms. Please read carefully.

1. General Use

• This website and its content (artworks, ceramics, images, text) are for informational and commercial purposes.

• You may browse, view, and share publicly posted content but may not reproduce, distribute, or sell any content without explicit permission.

2. Commissions

• All commissions must be submitted via the provided form or agreed method.

• Prices, timelines, and project scope are confirmed before work begins.

• A deposit is required to start all commissions and is non-refundable.

• Custom commissions are final; no refunds will be issued once work begins.

• Clients may request up to 2 small modifications after the initial draft. Any further changes may incur additional fees.

• Final files or physical pieces will be delivered only after full payment is received.

• The artist retains the right to use completed commission work for portfolio, social media, and promotional purposes unless otherwise agreed in writing.

• Cancellation or modifications must be requested before work begins; deposits are still non-refundable.

3. Sales of Artwork & Merchandise

• All sales (prints, ceramics, merchandise) are final unless defective or damaged in shipping.

• Shipping costs and estimated delivery times will be provided at checkout.

• The artist is not responsible for delays caused by shipping carriers or customs.

4. Copyright & Intellectual Property

• All artworks, ceramics, and designs on this site are the property of the artist unless explicitly transferred in writing.

• Purchasing an item or commissioning work does not transfer copyright unless explicitly stated.

• Unauthorized reproduction, distribution, or commercial use is prohibited.

5. AI & Artwork Use

• All artwork, including sketches, drafts, and final commissions, is protected by copyright.

• You may not use any of my artwork, including work-in-progress files, to train, feed, or generate AI models( including text-to-image or image-to-image models).

• You may display purchased or commissioned art for personal use (social media posts, personal collections), but commercial use or AI use is strictly prohibited.

• Thank you for respecting the hard work and creativity that goes into each piece. I appreciate your support in keeping my art safe from AI exploitation!

5. Liability + Shipping

• The artist is not liable for any damages arising from use of this website or its content.

• Digital downloads, images, or instructions are provided “as-is.”

• Once a package leaves my studio, I am not responsible for damage caused by the shipping carrier. I take great care in packaging your items and if you are worried, then i might suggest shipping insurance when placing an order.

• While tracking is provided, I cannot guarantee replacement if a package is lost in transit. I will assist you in filing a claim with the shipping carrier.

6. Privacy

• Personal information collected for commissions, purchases, or newsletter sign-ups will only be used to fulfill those services.

• Data will not be shared with third parties except as required for payment processing or shipping.

7. Modifications

• The artist reserves the right to update or modify these Terms of Service at any time.

• Updated terms take effect immediately upon posting.
